2. Acceptance of Terms

By accessing this website or engaging our services, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to these terms.

3. Service Description

Aldercrest provides advisory and operational consulting services focused on family business succession readiness, leadership transition planning, and ongoing facilitation support. Our work covers operational and relational aspects of transition; we do not provide legal, financial, tax, or investment advice.

Where a matter requires regulated professional expertise, we will identify this and may assist in connecting you with suitably qualified specialists. The decision to engage any such specialist rests entirely with you.

4. User Responsibilities

When using this website or engaging our services, you agree to:

• Provide accurate and truthful information when submitting enquiries or engaging services.
• Not use the website for any unlawful purpose or in any way that could harm Aldercrest or other users.

6. Fees & Payment

Service fees are set out in your engagement proposal. Prices are denominated in Malaysian Ringgit (RM). Payment terms and accepted methods will be confirmed in writing before an engagement commences.

We do not offer refunds once a session has been conducted or a deliverable has been provided, unless there has been a material failure on our part to perform the agreed scope of work.

If you wish to postpone or discuss changes to an engagement, please contact us early so we can work through a fair arrangement together.

7. Service-Specific Terms

Each engagement is defined by scope, timeline, and deliverables as set out in the relevant proposal or engagement letter. Any material change to scope requires a written agreement between both parties.

We work at a considered pace and ask that clients allow reasonable time for reflection and preparation between sessions. Outcomes of any advisory engagement depend substantially on the engagement and candour of all participants.

8. Disclaimers

This website and our services are provided in good faith and with reasonable care, but on an "as is" basis. We make no representation that our advisory work will produce any particular outcome for your family or business.

Nothing on this website or in our engagements constitutes legal, financial, accounting, or investment advice. Aldercrest is not a regulated professional services firm and does not hold itself out as one.

9. Limitation of Liability

To the extent permitted by Malaysian law, Aldercrest's total liability for any claim arising from our services shall not exceed the total fees paid for the engagement in question.

We are not liable for indirect, consequential, or incidental losses, including loss of business, revenue, or decisions made by family members arising from advisory conversations.

10. Confidentiality

We treat everything shared during an engagement with the utmost discretion. Information disclosed in sessions or correspondence is held in confidence and will not be shared with third parties without your consent, except as required by law.

We ask that you treat our frameworks, working documents, and proprietary approaches with equivalent care.

11. Termination

Either party may bring an engagement to a close by providing written notice. Fees for work completed to the point of termination remain payable.

Clauses relating to intellectual property, confidentiality, limitation of liability, and governing law survive termination.

12. Dispute Resolution

These terms are governed by and construed in accordance with the laws of Malaysia. In the event of a dispute, both parties agree to first attempt resolution through good-faith discussion.

If informal resolution is not achieved within 30 days, disputes shall be referred to mediation or the courts of Malaysia, as agreed between the parties.

13. General Provisions

• Entire Agreement: These terms, together with any signed engagement proposal, constitute the full agreement between the parties.
• Severability: If any clause is found to be unenforceable, the remaining clauses continue in full force.
• Waiver: A failure to enforce any term does not constitute a waiver of the right to enforce it on a future occasion.
• Assignment: You may not assign your rights under these terms without our written consent.
• Updates: We may revise these terms from time to time. The revised version will be posted on this page with an updated date.
